Kilmar Abrego Garcia是一名来自萨尔瓦多的非法移民，2025年3月15日被川普政府"错误"地遣返后，一直被关押在萨尔瓦多最严厉的监狱中(CECOT)。川普政府处理这一案件的方式，引发了美国政府的行政机构(白宫)与司法机构(联邦法院)激烈的正面冲突。

考虑到他返回萨尔瓦多将面临来自黑帮的生命威胁，2019年美国一名移民法官允许Kilmar Abrego Garcia 在美国合法的生活／工作。在被遣返前，Garcia与妻子和三个孩子一同生活在美国马里兰州。
2025年3月15日，川普政府"错误"地将Kilmar Abrego Garcia遣返回萨尔瓦多后，他在美的家人请律师将川普政府告上法庭。最终，美国最高法院 9:0 判决川普政府的行为非法，责成其协助 Kilmar Abrego Garcia 重回美国，并与法院(地区联邦法院／Judge Paula Xinis)分享事态的进展情况。

针对最高法院的判决，川普政府(司法部)有意推诿，声称Kilmar Abrego Garcia能否回到美国，取决于萨尔瓦多政府的态度(是否释放Kilmar Abrego Garcia), 除此之外，美国政府几乎无能为力。
4月14日，川普总统在白宫会见萨尔瓦多总统纳伊布.布克尔/Nayib Bukele时, 川普总统表示，Kilmar Abrego Garcia 返美一案美国政府无能为力，萨尔瓦多总统布克尔也心领神会地表示，(司法之事)这事情我也做不了主。就这样，借着克尔总统的掩护，川普总统公开对抗美国最高法院的裁决。
根据最高法院的判决要求，主审此案的美国联邦法官 Judge Paula Xinis 判决川普政府司法部运用快速程序处理此案件，并允许Kilmar Abrego Garcia 的律师询问政府行动的进展(做口供)／审阅相关文件。美国司法部不服判决，向联邦上诉法院申诉，其申诉被上诉法院3:0否决。

川普总统第二任期用"总统行政令"治国的方式，让国会几乎成了摆设，"制约与平衡"这一美国政体的核心精神，只能依靠司法系统来维持。在白宫与法院的频频对决中，"川普正在把美国变成集权国家"／"司法是否过多干预政府执政"，成为当下两个重要的时政话题。
在对Kilmar Abrego Garcia 返美一案最新裁决的解释中，联邦上诉法庭的三位法官从历史／现实／人性的角度出发，用优美感人的笔调，提醒川普政府，挑起行政机构与司法系统的敌对, 会给双方(国家)带来的巨大危险:

"现在，权力分支之间的摩擦已经到了不可逆转的地步，相互冲突只会削弱双方，"法官们说道。"这是一场所有人都会受损的争斗。司法机构将因其合法性不断受到质疑而遭受巨大损失，而由于惯例和独立性，我们只能有限地回应; 行政机构则会因公众对其无法无天的印象及相关的不良影响而受到重创"。(附录1)

三位法官表示，行政部门"或许能在一段时间内削弱法院，但随着时间推移，面对[逝去的云烟与本可能兑现的承诺]之间的差异，历史的书写将填补那一悲剧性的鸿沟，而法律最终将为自己刻下墓志铭"。(附录2)

法官们写道,"正如我们所述，本案可能让一个危机初现端倪，同时或许也带来了机遇。我们抱有希望地认为，相信行政部门的优秀同人视法治为美国精神之根本, 依然不是一个天真的奢求。本案赋予他们一个独特的机会来捍卫这一价值，并在还不太迟的时候，它也将唤起我们内心最好的品质"。(附录3)

2025年1月21日，华盛顿"圣. 约翰圣公教堂" Bishop Mariann Budde 在她布道中请求川普总统对非法移民／LGBTQ 人群给予慈悲和怜悯(附录4)；三个月后的今天，三位美国联邦上诉法院法官在判决书中试图唤醒川普政府执政的智慧。尽管他们诉求的具体内容有所不同，但都是在呼唤人性中美好成份。
人性中美好成份是人们共存的基础，社会繁荣的标志。也是三个多月来川普政府执政风格中欠缺的元素。

3. Court denies White House appeal of 'shocking' Abrego Garcia deportation case
"It is, as we have noted, all too possible to see in this case an incipient crisis, but it may present an opportunity as well," the judges wrote. "We yet cling to the hope that it is not na?ve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos. This case presents their unique chance to vindicate that value and to summon the best that is within us while there is still time."
